Understanding the Michigan Driver’s Licensing Actions

It is essential to remember that driving is a privilege in Michigan, and not a right. This means that the State can take away your driving privileges, whereas driving with a suspended or revoked license can result in further restrictions as well as imprisonment.

The types of driver’s license actions in Michigan range from the least serious (restricted) to the most serious (revoked):

  • A restricted license means that you can drive to specific, approved places, such as work, school, counseling programs, and for medical needs. A restricted license may also mean that you can only drive during certain periods of the day, such as between 8 A.M. and 5 P.M., and on certain days of the week. Generally, restricted licenses are granted after you serve a part of the suspension. For instance, if you were arrested for DUI and given a 6-month license suspension, you may be able to get a restricted license after serving only 30 days of the suspension.
  • A suspended license is more serious than a restricted one. In short, a suspended license means that you cannot drive for a period of time. The length of the suspension depends on the associated traffic or State law violation, the circumstances of the violation, your driving record, and more. Suspensions carry a “from” and “through” date, which designates the length of the restriction. After the suspension period, and if no other law violations have occurred, you can have your license reinstated by paying the reinstatement fee.
  • A revoked license is the most severe penalty for driving or State law violations. A revoked license means that you cannot drive for a designated period of time, such as a year. However, it is critical to note that a revoked license is similar to a terminated license. As such, at the end of the revocation period, you may need to reapply for a license at your local DMV. There are no guarantees that you’ll get your license back, and you’ll need to prove to the State that you’re a safe driver or that you’re sober from drugs and alcohol.

Driver’s License Hearing Requests

Just because you received a license suspension in Michigan, it doesn’t mean that you don’t have a say in the matter. If you want to challenge the State’s decision to suspend your license, you may be able to request an appeal hearing in court. In these hearings, you’ll appear before an administrative law judge or a representative of the Michigan Secretary of State (SOS), and you’ll need to clearly and convincingly demonstrate that you deserve your license back. In some cases, you’ll need four to six letters of reference from people who can attest to your sobriety and who can say that you’re low-risk for future DUI. In general, you’ll need to demonstrate sobriety for at least 6 months before the hearing, or at least a year if you have multiple convictions or you were arrested with a high BAC of 0.17 or higher. You may also need to submit a 12-panel drug screen and an alcohol assessment.
